Topic: Cyber Insurance Recovery Tips
Once the surprise wears off, a newly-served defendant in a cyber risk or intellectual property suit will start wondering how to pay for mounting defense costs and the exposure to loss, including the opposing party’s legal fees should the plaintiff prevail.
A company’s intellectual property and cyber risk should never left to chance and be protected by the best insurance policy available. But how do we know what exclusions will make our policy worthless?
Unfortunately, insurance defense coverage for claims arising from intellectual property assets and cyber risk is sometimes considered only after a lawsuit has been commenced, and counsel requests payment for legal bills.
It is crucial that we understand insurance brokers have no clue about IP or cyber risk and we must review with our corporate counsel all acquisitions, divestments and new business activities to ascertain that more than adequate insurance is in place for intellectual property and risk exposures to avoid being sued for infringement or be caught unaware from ransomware or other cyber loss.
